These Terms also apply to any job (“Jobs”) you engage with as a result of using the Platform, including services provided to third parties regardless of the site location.
By using the Platform or its services (“Services”), you agree to be bound by these Terms of Use. These Terms govern all interactions on Jobloads, including communication, feedback, and contract agreements.
Updates to the Terms: Jobloads reserves the right to amend these Terms by providing 10 business days’ notice. Continued use of the Services or participation in Jobs after amendments indicates acceptance. If you disagree, you must immediately stop using the Services and notify Jobloads.
2. Membership and Registration
To use Jobloads’ Services, you must register and become a user on the Platform (“Member”). Members can create an Organisation Account profile, which serves as a centralised hub for managing team roles, job postings, and communications. When creating an Organisation Account, you can invite others to join your organisation or manage it independently.
How to Create an Organisation Account:
Register as a Member: Sign up on the Jobloads Platform by providing accurate and up-to-date information.
Set Up Your Organisation: Create an Organisation Account by entering key details, such as organisation name, type, and contact information.
Invite Team Members: Use the platform’s invitation tool to onboard team members, assigning them roles based on their responsibilities.
Member Roles:
Hirer: Manages jobs, engages suppliers, and oversees successful project delivery for the organisation. A Hirer acts as the primary decision-maker for job postings and supplier interactions.
Co-Hirer: Supports the Hirer in managing jobs, coordinating with suppliers, and handling job-related tasks. This role is ideal for trusted team members assisting with operational responsibilities.
Supplier: Offers services to Hirers, manages their own teams, and coordinates tasks to meet job requirements.
Co-Supplier: Assists a Supplier by helping with logistics, task management, and team communications, ensuring smooth delivery of services.
Team Lead: Oversees a specific job or team, acting as the primary point of contact. A Team Lead may also handle job-specific administration and coordination.
Team Member: Executes assigned tasks under the direction of a Hirer, Supplier, or Team Lead, contributing to the job’s success.
Partner: Collaborates with organisations through the Jobloads Partner Network, providing expertise, resources, or connections to enhance seasonal operations.
Organisational Roles: In addition to Member Roles, Organisation Accounts allow for further permission-based access levels:
Admin: Full access to all platform features and job data for the organisation.
Manager: Authority to oversee teams, assign tasks, and monitor progress.
Collaborator: Actively participates in tasks with limited administrative privileges.
Guest: Temporary access for reviewing or consulting on specific jobs.
Observer: Passive, read-only access for oversight purposes.
By becoming a Member, you also agree to:
Uphold Jobloads' Core Values as outlined in What We Value, ensuring respect, collaboration, and transparency in every interaction.
Adhere to Member Standards, fostering professionalism and compliance with platform policies, including Hirer Member Standards and Supplier Member Standards.
Actively participate in the performance-based feedback system, contributing fairly and constructively to improve service quality and build trust.
3. Eligibility Requirements
3.1 Hirer Eligibility
Hirers using the Jobloads platform must meet the following criteria to ensure a compliant and professional environment:
Legal Authority: Hirers must be authorised to engage contractors and manage jobs within their jurisdiction. This includes compliance with local employment, tax, and workplace safety laws.
Business Registration:
New Zealand: Hirers operating as businesses must have a valid New Zealand Business Number (NZBN).
Fiji: Business entities must be registered with the Fiji Registrar of Companies (ROC).
Australia: Must have a valid Australian Business Number (ABN).
Sole traders in any country may operate under their personal tax identifiers.
Compliance with Industry Standards: Must follow all applicable industry-specific regulations and workplace safety requirements.
Accurate and Complete Information: Provide valid company or personal information, including contact details and site addresses.
Financial Responsibility: Agree to Jobloads’ service fees and ensure timely payment for all job engagements.
Jobloads reserves the right to verify the information provided by Hirers and to accept or decline registrations.
3.2 Supplier-Specific Eligibility
Suppliers from any country can operate as any type of legal entity, including sole traders, partnerships, companies, or trusts. Specific registration and tax obligations depend on the country of operation:
New Zealand: Must have a New Zealand Business Number (NZBN), with optional Goods and Services Tax (GST) registration. Sole traders may use their IRD Number for tax reporting.
Fiji: Must be registered with the Fiji Registrar of Companies (ROC) and obtain a unique registration number. Sole traders must also have a Tax Identification Number (TIN) issued by the Fiji Revenue and Customs Service (FRCS).
Australia: Must have an Australian Business Number (ABN), with optional Goods and Services Tax (GST) registration. Sole traders may use their Tax File Number (TFN) for tax reporting.
General Requirements for All Suppliers
Age Requirement: Must be at least 17 years old.
Identity Verification: Provide a photo ID and proof of eligibility to operate in their jurisdiction.
Single Profile Use: Operate under a single Jobloads profile to maintain transparency and accountability.
Jobloads reserves the right to verify the information provided and approve or reject registrations.
4. Jobloads Service Model
Jobloads provides a comprehensive job management platform and a business-to-business (B2B) marketplace that connects Suppliers with Hirers. The platform is designed to streamline workforce management, facilitate communication, and ensure compliance with legal and industry standards. Below is a detailed breakdown of the services offered:
4.1 Job Matching and Marketplace
Suppliers can list their services, showcasing skills, availability, and rates.
Hirers can post job opportunities, detailing project requirements and desired outcomes.
The platform enables a direct connection between Hirers and Suppliers through a secure messaging system.
Job proposals can be exchanged, negotiated, and finalised within the Platform, offering transparency and efficiency.
4.2 Comprehensive Job Management
Jobloads centralises job management, offering tools to streamline every stage of the job lifecycle:
Task Assignment: Hirers and Project Managers can assign tasks to specific team members.
Progress Tracking: Real-time tracking of milestones and task completion ensures jobs stay on schedule.
Document Management: Securely upload and share key documents such as contracts, certifications, and compliance records.
4.3 Collaboration and Communication
Jobloads fosters collaboration through:
In-App Messaging: Seamless, real-time communication between Hirers, Suppliers, and team members.
Shared Feedback Loops: Jobloads fosters collaboration through shared workspaces, structured feedback systems, and real-time messaging, ensuring transparency and alignment for all parties.
Notifications: Real-time updates on job milestones, task completions, or compliance requirements.
4.4 Compliance Tracking
Certifications and Licences: Jobloads tracks and verifies certifications, visas, and other compliance documents.
Automated Reminders: Notifications are sent to Suppliers and Hirers when certifications or documents are nearing expiry.
Audit Logs: Records of job activities and compliance status are maintained for transparency.
4.5 Partner and Supply Chain Integration
Jobloads supports integration with supply chain leaders through the Jobloads Partner Network:
Data Sharing: Partners and co-partners can access real-time job data, such as job status, progress, and compliance.
Dashboards: Visual dashboards provide insights into job performance and key metrics.
Permission Controls: Partners access only the data they have been authorised to view.
4.6 Payment Processing
Milestone Payments: Payments can be tied to specific job milestones, ensuring both parties remain accountable.
Multi-Currency Support: The platform supports payments in multiple currencies, catering to international jobs.
Service Fee Automation: Jobloads automatically applies service fees (3% for Suppliers, 6% for Hirers) when payments are processed.
4.7 User Roles and Permissions
The Jobloads platform provides flexible user roles to ensure efficient job management:
Admins: Full access to all platform features and job data.
Managers: Authority to assign tasks, monitor progress, and oversee compliance.
Collaborators and Team Leads: Active participation in job execution, with task-level access.
Observers and Guests: Limited, read-only access for oversight purposes.
4.8 Feedback and Recognition System
Jobloads provides a performance-based feedback system to help Hirers and Suppliers build trust, identify strengths, and maintain professional standards. This system includes:
Quantitative Metrics: Ratings on key attributes like communication, reliability, and timeliness.
Recognition Features: Badges and performance summaries visible to Hirers, showcasing supplier strengths (e.g., "Highly Reliable").
Qualitative Insights: Written feedback, visible only to the reviewed party, for constructive improvement.
Feedback ensures transparency while maintaining privacy, with public recognition limited to performance highlights like badges.
4.9 Risk Management and Dispute Resolution
Dispute Tracking: Jobloads enables tracking of disputes between Hirers and Suppliers, providing a clear record of communications and agreements.
Structured Feedback and Performance Summaries: Structured feedback metrics, including ratings and badges, are part of the job history and can serve as additional evidence in disputes. This allows for greater transparency in dispute resolution.
Incident Reporting: Any incidents during jobs can be logged and reviewed through the platform.
Support: The Jobloads team offers support to facilitate dispute resolution and ensure compliance with platform standards.
5. Member Expectations
5.1 Conduct and Behaviour
It is your responsibility to conduct yourself appropriately on the Platform and exercise caution when connecting with other Members. By using Jobloads, you agree to:
Engage respectfully and professionally with all Members.
Adhere to all platform guidelines, and relevant policies.
Agree to participate in the feedback system in good faith, providing fair, accurate, and constructive feedback to enhance mutual trust and platform integrity.
Uphold platform standards, including the Inclusion and Respect Policy.
Failure to comply with these policies may result in the suspension or termination of your Membership.
5.2 Platform Content
To ensure a safe online environment, Jobloads reserves the right, but is not obliged, to:
Remove or edit any content that violates platform standards.
Refuse to list or review content deemed inappropriate or outdated.
Feedback contributions must be honest, constructive, and align with Jobloads’ guidelines. Jobloads may review and remove feedback deemed harmful or inappropriate.
5.3 Use of Personal Information
Correspondence and exchange of personal information between Members must solely serve the following purposes:
Facilitating Platform Activities: Supplying, managing, or contracting services directly related to Jobloads' operations.
Feedback Utilisation:
Jobloads collects and processes feedback data to:
Highlight Supplier achievements through badges, performance summaries, and other recognition tools.
Provide Hirers with data-driven insights to support informed decision-making, while ensuring written feedback remains confidential and used solely for Supplier improvement.
To protect Member privacy:
Limited Use: Personal information (e.g., phone numbers, email addresses) shared through the Platform may only be used for platform-related activities, such as facilitating job engagements, compliance checks, or necessary communications.
Prohibited Use: Any use of personal information for purposes outside of Jobloads' operations, including unsolicited marketing or third-party sharing without consent, is strictly prohibited.

5.4 Data Retention and Disposal
When you no longer require another Member’s personal information:
You must return or securely destroy this information.
Upon request by Jobloads, you are required to confirm that the data has been returned or destroyed in compliance with these Terms.
6. Job Management and Contracts
Jobloads serves as a facilitator for job engagements but is not a party to any contract formed between Hirers and Suppliers. The specifics of each job must be negotiated and agreed upon by the respective parties.
6.1 Responsibilities of Hirers
Clearly outline job requirements, including timelines, deliverables, and payment terms.
Ensure compliance with relevant employment laws and industry regulations.
Provide necessary resources or information to Suppliers for successful job completion.
6.2 Responsibilities of Suppliers
Accurately represent qualifications, experience, and service capabilities.
Complete agreed tasks within the stipulated timelines.
Comply with all legal and regulatory requirements, including visa and work permit obligations where applicable.
6.3 Contractual Terms
Each job contract should include:
Scope of Work: Detailed job description and expected deliverables.
Feedback Relevance: Performance feedback gathered via Jobloads may inform future engagements, promotions, or Supplier selections but does not replace contractual obligations agreed upon for the specific job.
Payment Terms: Payment rates, schedule, and method of payment.
Cancellation Policy: Conditions under which either party may cancel the contract and any associated penalties.
Dispute Resolution: Agreed process for resolving any disputes arising from the job.
7. Job Cancellation
Job cancellations must be actioned through the platform’s Jobs page. Both Hirers and Suppliers must adhere to the following conditions:
7.1 Cancellation by Hirers
Hirers may cancel a job request before it is accepted by a Supplier without penalty.
After a job has been accepted, cancellations may incur penalties or impact the Hirer’s profile standing, depending on the timing and reason for cancellation.
7.2 Cancellation by Suppliers
Suppliers are expected to fulfil accepted job commitments. Job cancellations may result in feedback updates reflecting the outcome. Members who fail to fulfill commitments may see performance badges or ratings impacted.
In cases of emergencies or unforeseen circumstances, Suppliers should promptly notify the Hirer via the platform.
7.3 No-Show Policy
Hirers: If a Hirer fails to provide necessary access or materials for the job, they may be marked as a no-show.
Suppliers: If a Supplier fails to show up for a scheduled job without prior notice, the Hirer can mark them as a no-show.
8. Jobloads Partner Network
The Jobloads Partner Network allows organisations to share and access job data with authorised Partners. This feature aims to enhance collaboration and provide real-time oversight on job activities.
8.1 Data Sharing
Shared job data may include:
Job status, type, duration, and rates.
Supplier and worker details.
Compliance and progress updates.
8.2 Consent and Data Security
Members must explicitly consent to data sharing with Partners.
Partners are required to implement and maintain safeguards to protect the shared data.
8.3 Revoking Consent
Members can withdraw consent for data sharing at any time by contacting [email protected]. Upon revocation, Partners will no longer have access to the Member’s data.
9. Account Suspension and Termination
Jobloads reserves the right to suspend or terminate Member accounts under specific circumstances:
9.1 Suspension or Termination Grounds
Violation of these Terms of Use.
Unauthorised use of the platform.
Non-compliance with legal or regulatory obligations.
Engagement in fraudulent or harmful activities.
Misuse of the feedback system.
9.2 Impact of Termination
Members whose accounts are terminated will lose access to the platform.
Any ongoing jobs will be cancelled, and outstanding payments will be processed as per platform policies.
10. Content and Intellectual Property
Jobloads respects the intellectual property rights of its Members and third parties.
10.1 Member Content
Content shared by Members remains their property, but Jobloads retains a limited licence to use this content for service delivery. Members must ensure that their content:
Does not infringe third-party rights.
Complies with legal and platform standards.
10.2 Platform Ownership
Jobloads owns all rights to its platform, including software, design elements, and branding. Members may not duplicate or exploit any portion of the Services without prior written consent.
11. Security and Privacy
The security of Member accounts and data is a priority for Jobloads.
11.1 Member Responsibilities
Maintain the confidentiality of account credentials.
Promptly report any unauthorised access or suspicious activity.
11.2 Jobloads’ Responsibilities
Implement security measures to protect Member data.
Notify Members of any data breaches affecting their account.
12. Liability
12.1 Limitation of Liability
Jobloads is not liable for:
Indirect or consequential damages arising from platform use.
Losses due to service interruptions or third-party actions.
12.2 Member Responsibilities
Hirers and Suppliers are solely responsible for their engagements and compliance with applicable laws.
13. Disputes and Grievances
Jobloads encourages Members to resolve disputes independently but provides a framework for managing grievances:
13.1 Internal Resolution
Members should use the platform’s communication tools to address disputes.
Jobloads facilitates dispute resolution by allowing Hirers and Suppliers to reference structured feedback, written comments, and performance badges, providing an objective record of prior engagements.
Jobloads may mediate but does not guarantee resolution.
13.2 Escalation
Unresolved disputes may be escalated to external arbitration or legal proceedings, subject to the laws of the applicable jurisdiction.
14. Final Provisions
14.1 Governing Law
These Terms of Use are governed by the laws of New Zealand, Fiji, and Australia. Disputes will be subject to the jurisdiction of courts in these regions.
